The City of Battle Creek utilizes a two-step application process for Adult Use Marihuana Establishment licensing. Application:
Step 1: For initial 90 day Conditional Permit - Completed Part A Application; Michigan ID or Driver's License for the applicant, business owner and managers of the facility; proof of ownership or legal possession of the premises; City issued signed zoning assurance letter; Articles of Incorporation, Partnership, Charter or other organizational documents; State of Michigan Licensing and Regulatory Affairs Department verification (prequalification approval); Completion of Pick List (Retailer and Microbusiness only); Criminal History Disclosure and Background Record Authorization for each person listed on the application.
Step 2: For Final Permit - Once the applicant has completed all requirements of the 90-Day Conditional Permit and obtained their final AUME Permit from the State of Michigan Licensing and Regulatory Affairs Department, a completed Part B Application must be submitted along with a copy of the State of Michigan AUME Operating License, Certificate of Occupancy for the premises, copy of State Approved premises security plan, proof of payment of any outstanding taxes, utilities, liens, etc., as determined by the City Treasurer & evidence of valid and effective insurance policies.
Employees: As part of the permit process, each person employed by the permit holder must be reported. The permit holder shall report new employees to the City of Battle Creek within seven (7) business days. A copy of valid picture identification for each employee listed must be submitted with the New Employee Application.
There is a non-refundable fee $20.00 for each employee added after the annual permit is issued.
Rescission: An applicant may rescind an approved Conditional or Final AUME Permit at any time to effectively remove such Permit from the associated property. Once a rescission is effective, an applicant receiving the approved rescission cannot file a new AUME application within 10 business days anywhere within the City of Battle Creek. No fees paid in conjunction with the rescinded approved Conditional or Final AUME Permits shall be refunded.
Conditional Permit Extensions: Extensions may be approved by the City Clerk based on substantial work having been completed as determined by the City and at the request of the Applicant 30 days prior to the expiration of the Conditional Approval Permit. Only one extension is permitted.
Renewals: All Adult Use Establishment permits expire on December 31st and must be renewed on an annual basis. To renew an existing permit the licensee shall submit an renewal application no sooner than 90 days before the expiration date and no later than 60 days before the expiration date. An application for a permit renewal received after November 1 of each year shall be considered late and will be subject to a late fee.
